TERMS & CONDITIONS - LIVE RELEASES, DISPLAYS, KITS & INSECTS

Our objective is to provide beautiful healthy Monarch butterflies, eggs or insects to you to make your occasion or learning experience truly special. From time to time things happen outside our and your control, therefore all orders to Butterfly Karma for live butterfly releases, displays, kits & insects are subject to the following Terms and Conditions:

All live orders are subject to availability of butterflies and should be placed a minimum of 6 weeks before the date of your occasion. Breeding kits, eggs, insects or plant orders are seasonal and are subject to availability.

For live releases a 50% non-refundable deposit is required to secure your order. Final payment must be received in our office no less than 6 weeks prior to delivery. Cancellation of orders will only be accepted in writing and must be received no later than 6 weeks prior to the contracted delivery date. If full payment has already been received, 50% will be refunded. If cancellation is within 6 weeks of contracted delivery date all monies will be forfeited. Payment for purchases of breeding kits is expected within 7 days of delivery. Payment for other purchases will be arranged at time of order.

We accept payment by cheque or credit card. If paying by cheque, your order will be confirmed when the proceeds are cleared by the bank. If paying by credit card, you may authorise us at the time of ordering to charge your credit card for both the deposit and the balance of your order.

Butterfly Karma does not take responsibility for failed butterfly releases where instructions provided have not been followed or release occurs in conditions of strong winds, rain, after dusk or below 17 degrees Celsius. Butterfly Karma does not take responsibility for failure throughout the breeding process for butterflies, silkworms or stick insects where instructions provided have not been followed or an act of nature occurs.

Should the Purchaser or nominated person fail to make themselves available at the place and time agreed by both parties for delivery, live butterflies will not be left unattended. Butterflies will be returned to Butterfly Karma and the order cancelled with all monies forfeited. Breeding kits or insects may be left unattended by prior arrangement only. 
 
In the event butterflies, kits or insects are delivered by Courier, Butterfly Karma takes all care but no responsibility as to failed delivery or misadventure of the said Courier Company. Delivery to some remote areas, rural or outer metro may be excluded or delayed. All deliveries will be made between the hours of 8.30am -  6.15pm normal business days.
 
The purchaser agrees to indemnify and hold harmless Butterfly Karma, its owners, employees, and volunteers for any liability arising from any death or bodily injury (physical or mental) to the Purchaser and to third Parties resulting from the use of our services, as well as any loss or damage (pecuniary or otherwise) to any property, to the purchaser or to third parties resulting from any use of our services (direct or indirect), in whole or in part. In any event Butterfly Karma will not be liable to you for any loss or damage in any amount greater than what you have paid us.

In the event Butterfly Karma is unable to fulfill any order through destruction of butterflies, kits or insects in transit by act of God, fire, theft, malicious damage, or by force of nature, Butterfly Karma guarantees to make a full refund of monies paid, less a 10% administration fee.

Butterfly Karma reserves the right to cancel orders at any time at its absolute discretion and if this occurs you will be entitled to a full refund.

In the unlikely event your butterflies or insects have been delivered to you suffering casualties please contact us immediately. Upon their return to Butterfly Karma within 3 business days you will be entitled to a full refund for those expired. 

Following delivery, the care of your butterflies, kits or insects is your responsibility. Butterfly Karma will supply you with handling, release and breeding instructions but will not be responsible for any loss or damage. In particular, we are not responsible for failure of eggs/caterpillars to transform into butterflies.
